You’ll learn to identify the legal risks involved in cloud computing transactions - and to suggest possible solutions. I really enjoyed this course. I highly recommend this course to people involved in negotiating and approving ICT contracts as we all move deeper into the Cloud. It confirmed many of the issues I have come across in ICT contracts, particularly around liability, data security and forum shopping. It also highlighted some real issues regarding the legal ownership of IP. It also gave me an insight from the service provider's standpoint of why they may need to include some terms that, at first blush, appear unreasonable. It explained that these terms could be necessary due to the inherent nature of cloud-based services rather than exploiting their market dominance. While the course looks at the law from an English and European point of view, many of the issues are mirrored in NZ. The course also explains in simple terms, some of the more tricky elements of Private International law. For example, choice of law contract terms and conditions that can be so critical to resolving disputes. These terms are counterintuitive and easy to misconstrue. Some ICT contracts and many Cloud Computing contracts agreed in NZ allow foreign courts to decide disputes (even if the applicable law is NZ law). In reality, this can effectively limit the enforceability of the contract due to the cost and practicality of engaging and briefing a foreign lawyer.
